hi you out there,im married to a hubby that has just informed me he cant cope wi the debt,i am disabled he takes care of me an money..... 12000 in his name an 19000 in mine.renting an on benefits cos of my disability. some advisers have told us to just stop paying various cards an loan. however i cant get my head round that if you stop paying as well as hassle,the o.r.would then ask what we did with surplas money that we must have by not paying creditors? the loan has just been taken out4 weeks ago to try an cope but just getting eaten up.also been advised to not stop this payment, as could get trouble from or for knowing no funds to pay it back.however if we keep paying loan that could be seen as favouring a creditor. so confused its only this site keeping me going. also does anyone know if you can still recieve an i.p.a when on disibility living allowance.

You are correct regarding the payments. You cannot pay one and stop the others as this is seen as preferring one creditors over the others.
Your OR is likely to be miffed about taking on more debt recently without any means to repay it. BUT - what can he do about it?? You have done it, it cannot be un-done, so they may gripe and apply a BRU. A BRU is where the bankruptcy restrictions are extended for some years past your bankruptcy - so you cannot get credit, be a MP and so on). That is the WORST that they can do to you over it.
DLA is not a means tested benefit, so "technically" an IPA could be applied, but I assume that neither of you work and this is the main income? Put up your SOA here and we can take a look for you about this. Its unlikely an IPA will be applied but it does depend on income and outgoings.
If you are going to stop paying everything, then you need to be sure of the decision - as its difficult to go back on that and catch up with payments.
Once you stop payments, its usually several weeks before creditors start chasing you, so there is a few weeks grace. And you do not have to talk to them either.0 -
To add to sky brill reply,if you stop paying creditors, you have the bc fees to pay,this could be used for that. If you get a discount it would still be £345 each,if not thats £495 each. Most people stop paying creditors and put the money towards the fees.
