Out of stock item, but card still charged

Just after a bit of advice...

I purchased a tent from the Jo Royle Outdoor website.

The tent in question was showing as in stock, so I went through the checkout process gave my credit card details over etc.

After a few moments I received a confirmation email, saying that my order had been received & payment had been taken.

About 24hrs later I received an email from someone at the shop saying that the tent I had ordered was not in stock.

They have offered me two options, buy a more expensive tent or refund my credit card.

Is this legal? Taking money for goods they do not have?

Any thoughts/advice would be great.

  • Has payment actually been taken and not just reserved from your credit card ?

    This happened to me recently - I ordered the goods, received the email and the funds reserved from my balance but not 'taken' if you understand me.

    As the goods are out of stock they've cancelled the order and an no longer have reserved the funds.

    They have offered to cancel the transaction. What's the issue?

    These things happen. Sometimes you can order goods marked as in stock on the website. Your order is placed and card charged without any human intervention. It's only when your order gets to the packing stage where a human is involved, that the store realises there is an inventory error and your item is out of stock.

    They've offered a refund so I would either take that or buy the more expensive tent if you like it better.
