Going BR soon and need some help on bailiffs

Hi all, new here but have been reading through a few threads.

I'm going BR in the short future and was just wondering about a few things that have been troubling me.

I will be declaring to the OR that I have no assets (nothing apart from the basic essentials but definitely nothing extravagant)

Will the OR take my word for this or will they send bailiffs around to go through my stuff?

Bearing in mind I live with my parents and don't own my own home. This is the main thing that is troubling me, having people coming to the house :(

Also I have a small car (a banger) that is worth a couple of hundred quid or so. Will the OR automatically be able to check via some kind of database of what vehicles I own or will I have to declare it for him to know it belongs to me?

    Hi Scotty...welcome to the world of bankruptcy!!

    I think that many people still think that if you go BR that you will lose everything but as you will have read that is not the case at all.

    Baliffs will not call if you are BR they are not allowed to hassle you. If you have pressing debts b4 you declare then it is possible that they could call beforehand though!!

    The OR will examine your financial affairs & usually will take your word for assets you own...after all they go through your financials.with a fine tooth comb so will find out if you try to hide anything. Generally I think it is assets over £1k but I am sure someone will correct me if I am wrong.

    The OR does chk the DVLA records so will know what vehicle you own & any you have sold in last year or so....I believe they can go further back if required.

    Hi scotty_m and welcome. No bailiffs will call to your home. The OR will check with DVLA to see if any cars are registered to you - so you need to be honest on the forms and list the car.

    Hi :) As far as I am aware bailiffs can only be instructed once a CCJ has been agreed by the court and even if they have been instructed, they can only go through your things if you let them in. The OR doesn't go through your things or instruct bailiffs, they only ask you to list any items of value which are worth over £1000. (Don't do what I did and include everything in the house and attach price tags to it...lol I even put down the pc desk at a fiver)

    The OR sends no-body. A lot in BR is taken upon trust, but the OR will be very experienced in working out those that lie - ie, he will get all your statments and if there is a £2k purchase from Currys in the last month and you have not declared it... well, they are not daft!

    The OR will only send someone to take a declared asset - so if you declared your £50k Bentley they would send round a specific collection agent for this one item and they don't snoop on anyones behalf either!


    You have to declare the car - the OR WILL check with the DVLA as to what you own/have owned (or rather, what is registered). Do you work?? If so, then the car is likely to stay with you anyway as its an essential. If you do not declare the car, then they will be miffed and assume you may be hiding other stuff and you will get probed!
