Hi Guys,
Little bit confused today
We recieved a letter from Natwest bank today stating that as they have not been paid in accordance with agreed arrangements they will be referring matters to the banks solicitors and commencing legal action and a view to commencing psession proceedings where appropriate.
OH went bankrupt in September and we also moved out of our property around this time.
Hubby had a bank loan with Natwest with £75,000 still owing on it,they also had a second charge on the property.
Hubby decided to ring them and tell them he was BR (we had sent a letter to them at the time also)
The snotty guy on the other end of the phone when told he should be dealing with the OR told hubby he was within his rights to be contacting him and would be persuing him for the debt as they had a second charge on the property, can tey do that?He asked all sorts of questions like how much was the property worth and why had we moved out.OH put phone down on him in the end but it has left us a little shaky and confused!
Any help would be appreciated

Have they actually repossessed yet? If not, then yes, they are legally allowed to chase you as the debt has not been included in your BR. Although the debt will come into your BR eventually, so its pointless chasing - but they have policies I guess. There is nothing they can do. Let them waste money getting solicitors etc.
If they have repossessed then there is naff all they can do about it point blank.0 -
No not been Reposessed yet,we had another letter last week from Mortgage express saying that if we had not paid our arrears within 14 days they would begin reposession proceedings,we have also spoken to them a few months back about the BR but they seem to have not even acknowledged that conversation!Maybe we should send the keys back?
So they can chase OH but if we just ignore them they wont get anywhere?
He is now kicking himself for answering a few of the guys questions
Is there anything anyone can do to make things difficult for us?
