Being Sacked Whilst on The Sick

My partner got sacked whilst he was on the sick.

In fairness he did cause the company a lot of damage by making a mistake

but... I didn't think u could get sacked whilst on the sick?

They did really pressure him to go down for a chat and then fired him

    Maybe he got sacked for the damage/mistake rather than being sick?

  • My understanding of it was that you can be sacked whilst you were on sick leave, So long as the sacking wasn't owing to the fact that you are on sick leave. Maybe he was sacked for negligence / mis-conduct. ( please do not take this personally, i am not trying to implicate your partner in anyway, except for that of your admission)

    Can anyone confirm this? :confused:

    The standard procedure is verbal, written, verbal and then the next written is the means of delivering notice. Could the "chat" have been the second verbal warning?

    These can be waived if it is deemed that the employee has acted wrongly in such a way that it is detrimental to the business e.g. gross misconduct then he can be sacked immediately.

    You can be sacked while off sick.

    You are not sacked for being ill, you are sacked because under capability rules, ie you are incapable of doing your job (because you are off sick).

    In the OP case presumably the damage can also be added into the mix.

    How long had he worked for them? Can get free adivce and now not working from the community legal service. The acas website is good too.
    Green and minimal chemicals is the new black- I know a fair old bit about sustainability, specially energy and transport stuff. If I can help- please ask!
