Thankyou fiveryearplan is that definetly correct as the other replies seem to disagree, the mortgage is in my madien name, all the debt in madien name, bank account in madien name, passport in madien name, driving licence in madien name etc only thing is tax office snet new code thro in married name.
Yes want house to be repossessed then rent but will have massive shortfall approx 50,000.0 -

I am right in thinking then if all the debt in my name alone then thy wont chase him regardless of bein married as it wasnt joint debt?
I am scared of getting done for fraud as well not avoiding telling the truth as I was married when I applied for all the credit and the mortgage and didnt declare this as I didnt want associating with my hubby bad credit rating - rather ironic now I know.
Dont want to land myself in a fraud case.0 -
What your name is totally irrelevant - the only relevant thing is whether it was joint credit. You could take it loans as Mrs Smith or Miss Jones, only you are liable. Your name is irrelevant - you could change it Martin Lewis by deed poll and it doesn't matter. When you go bankrupt it will be by all names.0 -

I'm still a bit confused
If the debt is ALL yours, and your husband's name is not on it in any way shape or form, they will NOT chase him.
If the debt is JOINT or SHARED with your husband, regardless of what name you signed it in, if you go BR they will chase him for it.

ALL the debt is mine even the mortgage his name is on nothing at all so if the house did get repossessed could thy chase him just because he is my husband even tho his name has never been on mortgage?
Also am I being paranoid or could I be done for fraud for not puttin down that I was married when I applied as I was a Mrs legally not Miss and I applied for it all as Miss.
Sorry if I am confusing everyone confusing myself my head is all mushed up dont think my hubby and I will be toghether much longer at this rate I am like a zombie glued to my laptop.0 -
