Advise needed on wages not being taxed

  • I would contact the revenue if I were you. Although it is the employers responsibility to deduct tax and ni, you are also obliged to pay it, so the tax man can still ask you for a backpayment. For tax this would usualy be done by putting you on a new tax code so you pay it back gradually, not sure how it would work for ni.

    However if this is your first job in the tax year and we are getting near to the end of the year, it may be that you have not yet his the threshhold to start paying tax. That won't be the case for ni, as ni always works on a "this" month basis, rather than looking at the year so far.

    Even if there was a clause in the contract of employment to allow the employer to make deductions from pay, this could not be enforced as it is unlawful in this case, the responsibility for deduction of tax and paying it over resting with the employer, not the employee.

    Agreed with fengirl.

    If this is your first job since April 2008 then I wouldnt worry about the tax, you will not have reached the 6035 cumulative amount yet to start paying tax.

    However, NI is not on a cumulative basis and should be deducted on anything over £97 per week!

    this isnt my first job since april2008 i have emiled someone who deals withpaying us and iv paid £51 ni but no tax? why would this be?
    if im not snowed in tomorrow i will be emailing to find out why no tax as its my 3rd pay from there now

    Do you have a payslip to hand? It should list the following

    Tax code
    Earnings to date
    Tax paid to date

    Did you supply them with a P45 from your previous employer? If so these figures should be in the figures above.

    If you didnt submit a P45, did you submit a P46 in order for them to decide which tax code to use. If yes then which box did you tick?

    we dont get our payslips till my bosses boss come down and brings them very annoying as he came down last week and didnt bring them grrrrrr yes i gave them my p45 suppose i'll just have to wait but i know my boss hasnt been taxed and shes been there few months longer than me
    i will get there!:beer:

    So they seem to be breaking the law again here. Payslips have to be provided when or before the money is paid to the employee.
