Law on job vacancy

Hi Guys,

Recently someone came to be interviewes for the same role as I do currently, When they arrived they were told they were being interviewed for a senior role, My Question is that this senior role was never advertised.... Do employers HAVE to advertise a vacancy?

    No legislation says vacancies have to be advertised

    there might not be a law, but within the institution they may be an agreement to promote from within and if no one suitable can be found, they go outwards.

    I work for a 'division' of such an institution (NHS), and they always go outward - the inside people have 'too little qualifications' (even if they are over qualified for the position advertised) which leave people in a dead end jobs and then the management wonder why they are despised, hated and untrusted.

    Apparently at this years Xmas party out of a staff count of around a total of 140, 20 people actually attended (if that). 'Management' looked through a local pub window and could not understand why the 10 people did not attend.
    GOOGLE it before you ask, you'll often save yourself a lot of time. ;)

    It really isn't fair but seems a fact of life, public or private sector. I've seen many a new post, be it an existing vacancy or new position, that I would break my neck to advance my career in but it's gone to others, mostly without interview and after the event. I've put down to politics, where in spite of clear talent and aptitude, decisions are made for reasons that defy business logic. But then again, most business decisions are made for non-business reasons. :confused:

    By law,
    Private sector - no
    Public sector - sometimes, depending on grade & department
