Hello
Im loooking at leaving my house to go into rented and leaving my house to get repo
I have sneeking suspicion that once I leave my ex will take up occupancy with his bit on the side (its jointly owned and mortgaged) and start paying the mortgage.
he might be able to keep up payments for a year or, so but if he still has the same gambling habit it will end up repo, by this time I might be discharged, what would happen to any shortfall after discharge?????

Hello again
Just found this on the IS website, am I reading it right any repo shortfalls after discharge will still be included in my BR
If you continue to live in the property it is likely that you will continue to make payments to the mortgage loan company to avoid the property being re-possessed. When the property is eventually sold any
shortfall to the mortgage loan company is still a provable debt in the bankruptcy, even if you have been discharged, as you are released from the debt on discharge.0 -
Yes, you're right, even if he defaults on the mortgage your liability ended with your bankruptcy, the entire lot will fall to him.Accept your past without regret, handle your present with confidence and face your future without fear0
