BR/DRO Surplus & Jt debts

Hi,

I am looking at the option of going for a DRO in April should it all be rolled out by then.

Two questions. The surplus before IPA is £99 for br & proposed £50 for DRO. How long is this in place for? Is it just until discharge or for the 36mths to allow for any future ipa's?

Secondly with regards to jt debts, do you just divide them equally?

I'm thinking of doing a DRO and my partner BR (his debts are over £15K we think), I'm asking about the jt debts so I can work out each of our total debt.

Regards

I would think it depends on timing. If he went BR before your DRO then all of the joint debt would be yours. I don't really know how it would work if you did your DRO first then I suppose all the joint stuff would go into his BR. Sounds logical but logic isn't always what these things are based on.

    Hi,

The debts will count in full for each liable person. There is no provision in a DRO for IPA'S, they dont exist. If your spare income is assessed above £50 p.m. then you cannot have a DRO.

  • Thank you all for your replies,

Do you know how long are you expected to show the surplus for then? Will it be something that will be randomly checked? Obviously you can't hide money but I thought a dro would be a better option as it is more affordable - should our soa/surplus allow it.

I'm just trying to work out if we can live on a £100 surplus (x2 £50).

Also, why is it lower than that of br?
