    To be valid a CCA has to include the prescribed terms and the terms and conditions.

    Cant find the PTs at the mo - very tired but they vary depending on what the account relates to.

    A lot of things that arwe called CCAs are mere application forms.

    Responses to CCA requests do NOT have to include a signaturen but if they go to court they have to produce this, so challenge them ans do a SAR if they start legal action.

    I've scanned the received CCAs in to my PC and would like to run them past you all but I'm not sure how to add them. I saw that some people supply links to a photo website where they've saved their docs but can't remember where, what would you suggest is best?

    Alternatively does anyone have a link to the prescribed terms please?

    As a bit of a twist Holmwood Termtime Collections have stated that as they ask for 4 payments they don't fall under the usual CCA rules.
    In response to my CCA request they sent us a signed application form with some of the figures crossed out, reentered and initialled, but not by us.
    They are chasing us for one month's payment of £850 (we cancelled last year) and have now sent a court claim through asking for £150 on top, 4% interest persuant to a contract that we don;t have and have never been sent and other interest and costs making the total £1150 now.
    I am just about to Acknowledge Service intending to defend but I'm not sure (apart from inconsistencies in charges/interest which are different in the contract on the back of the leaflet we received originally) if there any contractual CCA type prescribed terms that they should have on the form they sent back.
    (if I need to start another thread please let me know and which would be suitable)

  • Hi, have never used forums/online chatrooms etc before so apologies if I'm going about this post the wrong way. I have been reading a thread pertaining to CCAs. I req’d this from Barclays Jan 09 and rec’d a photocopied generic one in Mar 09. It states BC Agreement for your records, BC conditions of use. No details, name, address etc (as per the majority). I am going to follow your advice and send the ‘my request under the Consumer Credit Act 1974’ . I requested this for TWO accts and only rec’d for one. I am not trying to get out of paying ‘what I spent’ but have found APR to rise extortionately, I have tried to offer Mercers reduced payments (they want more and I cannot manage) and asked them to freeze interest they refused.The ltr I rec’d with generic CCA says “copy of your executed agree’t enc’d. Accept apologies for delay. Documents enc’d are: original CCA”. No other enclosures !! It then stipulates, credit limit, balance, next payment due. It then says T&C will be sent under separate cover.Am I heading in the right direction by sending the aforementioned letter ? The agreement is not an original. Is there anything else you can guide me with re. above ? I got a debtor at my door last week, I thought that no action could be taken until the CCA had been provided !!! Have I misunderstood ?Secondly, Egg have asked that I forward a signed doc and/or utility bill to receive CCA. I have read that they scan this signature and add this to a CCA if they can’t find original. Surely I shouldn’t have to provide them with this info, after all they have my address and I have both a CC and loan with them.Many thanks for your advice Janglibillee (Hopefully I'll be able to pick up the response wherever it may end up)
