CCA help !

After being advised to go BR by CCCS, and posting on here someone recommened I send off for copies of the CCA for the credit cards I owe, got the first one back today from one of the credit card companies which is a photocopy of my original application form which I signed in 2005 plus 2 sheets of A4 paper which they have obviously just made up on the computer when I have requested my CCA from them which sets out the terms and conditions of an agreement between us ******* Bank and me, stating interest rates, default charges and so on, it says "we wil tell you your credit limit when you first receive your Credit Card.

Funny I've had my card for 4 years now, and the terms and conditions has my new address on where I haven't even lived here for 12 months yet, surely it should have my original address on if this was the original CCA.......plus they just sent a letter with my current balance on........

On the letter it says that they have enclosed a copy of your signed credit agreement (think they mean application form :rotfl: )and current terms and conditions.......

Well I'm thinking surely that is not right, that wouldn't be legal, they can't just print off a terms and conditions sheet and call it a credit agreement.....I could have done that, surely that wouldn't stand up in court........would it.....

Does anybody have any information on this......are they trying it on......

    my own view on this is that you have two ways of dealing with it.. if you are going to go bankrupt then cca's etc don't really matter (i probably could have claimed back PPI's and requested cca's) as bankruptcy will mean your debts become the OR's problem, not yours.
    However if you want to try and sort out your debts without going BR then going the CCA route may well make some of your debts unenforceable (you will still, technically have them but you can't be hassled for them ... someone else will probably explain it better)

  • It doesnt surprise me they are resorting to these low life tatics. I have successfully got 2 card balances cancelled off - Barclaycard and Northern Rock/Co-Op due to either poor microfiche application form or doesnt exist. This is a new one to me and best advice is to go to forums on www.consumeractiongroup.co.uk and sign up on the forum and post the question under debt collection industry. The regulars on there come up with some ingenius letters tailored to your circumstances to put the DCA's back in their place. Good luck!!

    With regards to credit referencing without a proper signed agreement the companies are not allowed to process any details - ie report to credit reference agencies so you can pursue them to restore and clean up their data and remove the default. Bit of a hassle so some people rather wait 6 years for it to drop off credit file whilst other go for juggular!!!
