Emusic -HELP! Money taken from me!!

OK, apologies if this is in the wrong place- I am sure this will be moved if it is!

Basicly I have looked back at my past bank statements as I am shredding them. Its because I spent the past year running from them (know this is not advisable) and lo and behold an odd transaction.

I can see on my account that on the 4th oct £14.99 was taken from my Emusic account- an account I am 100% sure I cancelled. I then see on the 6th october, £143.90 taken from my account to e-music. !!

I have called emusic who told me I had a live account with them. I told them it must be a mistake as I have not ever used the site, (I joined and then cancelled the same day as part of a cashback deal). I have no downloads from them (am assuming thats what they offer) and have not ever logged onto the account.
I asked for a full refund as I had cancelled and yet £143.90 was taken ONTOP of the £14.99 and was told no, I am not allowed to do that.

I then contacted my bank, this is theft as I see- I cancel an account, the company take loads of money from me. But I am told by the bank that its not able to do anything as I gave out my details to the company.

I do not have any emails from the company, no bill, no recipet, and more importantly, no cancellation email. I assumed this was because my spam filters weeded it out.

Though I have now managed to cancel the account as of yesterday by my request, I am told the account actually runs out on september 28th 2009 and should I want to use it...blah blah blah.... but I do not want to use the site! I want the money they took from me back!

I just can't make sense of it: I can see £14.99 as a running subscription for each month, but not £143.90 all in one go! I am not that daft that I would have signed up for an entire year!

Is there anything I can do? does anyone know what if anything I can do? I cannot afford to lose that money and it would very clearly explain why I have and was struggling so much during that period last year. I need that money back! can anyone advise?

    Just incase anyone had been following/in the same situation, I have infact been able to get a refund of £143.90 from emusic after many phone calls and 5 emails begging/pleading for a refund. I am happy to get the £143.90 back and though was still charged a further £14.99 in error, to be honest I am happy to let that go.

    If anyone else is or has been in a similar situation, there is hope out there!
  • I'm just about to start pursuing eMusic for a similar amount and it would be really helpful to know more about how you got a refund, jenniewb! In particular, what phone number you used - I can't find one anywhere!

    I was thinking about taking their free trial of 25 songs and then cancelling, but after reading this I don't think I will bother.

    I got a "50 free downloads with eMusic" from LoveFilm yesterday, so signed up today. The whole service is naff... not a single artist I searched for was available! Canceled about 20 minutes later.

    Thanks for the heads up... I have printed out the "sorry you're leaving" email just in case.. and I'll keep an extra special eye on my statement for these jokers.

    Please could you tell me what the phone number is? I can't find it anywhere and in the meantime they are carrying on charging me after I've already cancelled my account.

    The credit card company won't help at all and say that changing my credit card number or cancelling the card wouldn't stop them from charging me.

    Ahhh! I don't have the number anymore!
    But the way I found it was to google for it- tried variations of "E music" and "Phone number", if your able to get someone else to pay your phone bill, you could always try 118118 or etc.

    They DO have a number based in the UK. They also have a number based in the US and I think that both helped. The helplines are actually based in the US if I remember correctly. They are not total b******s so don't get to stressed out! Is there anyway you can contact your CC and say that you have cancelled the subcription and have proof (emailed proof?) that you have done so and yet are still being charged?? they may be able to stop them dipping into your account that way.
