Letter from creditor...

Hi all,
Hubby received a letter from egg today, reads as follows:

Dear (bankrupt hubby)

We ahve been notified that you have been made Bankrupt.

Please do not use your Egg Card and if you still have a card please destroy it.

We will now deal with the court appointed officials regarding your account, although we reserve the right to contact you regarding this matter should we require any further information.

We will be notifying the credit reference agencies of this situation with immediate effect.

We will be seeking payment from you for the full amount that you owe us under this agreement as at the date of your Bankruptcy and we will be negociating with the Official Receiver for payment of this sum.

What I need to know is this, Can they still contact us? it is not a secured debt, and what do they mean by they will be seeking payment from us in full?? i mean surly if they know we are BR they know they dont have a hope?

    They mean that they will put a claim in to the OR for the full amount. They have worded it badly (perhaps on purpose :rolleyes:).

    Once they have confirmation of the bankruptcy and contact details for the OR, then the shouldn't be contacting you any more.

    If they do then refer them to the OR, and forward any letters to them as well.

    They will be negotiating with the OR to try to settle the sum owed. They mean that they will liase with him to see if there is anything in your estate to pay them.

    Its a stupid, badly written letter. They are not allowed to chase you - its illegal to chase a BR for payment on a debt thats included in the BR, so please do not worry about it at all. Keep the letter though as they state they know about your BR, so if they do chase you, you have proof they know all about it.

    As I said - don't worry. There is NOTHING they can do. The debt is in your BR, your OR is facilitating those debts and they will have to try to get any sum from your estate.

    :rotfl: :rotfl: :rotfl: Citi tried to contact me after BR, after letting them waffle for a bit i asked if they where aware of the law regarding herassing a BR.........they hung up:confused::p :rotfl:
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(
  • It is a stupid and badly written letter yes, including the spelling mistakes :-)

    I presume it was the OR who had contacted them in the first place. If they do try to contact him agian I will mention the laws thanks guys for putting my mind at rest, when I first read it I thought the phones were about to ring again..... Not heard anything from the halifax credit card who used to call nearly every day including sunday.
  • I received the very same (worded) letter from Egg this week (twice, as I had 2 cards with them), they've been put in a pile called "To forget about and do nothing with" ;)

    I suspect the wording is quite delibrate, a last attempt possibily to get a naive person to pay. I got a virtually word for word letter from Cap One, rather amused me.
