Overpaid by previous job - advice needed

I'm posting this on behalf of my friend, I'd be grateful for some opinions.
My friend has had a new job since Sept 08. She has recently received a letter from her previous company stating that they overpaid her £X amount and they would like this back (or they will take her to court)
Where does she stand with this?

If they overpaid her then they have every right to ask for it back - if she spent it then, its tough basically because she has benefitted from an error and has 'taken' money to which she has no entitlement.0

She needs to pay it back, but if it's a large amount and/or she would struggle to pay it back all in one go, then I'd suggest she works out how much she can afford per month and writes to them pointing out that it was their error, that she couldn't have been expected to realise that she had been overpaid (assuming that's true, of course!) and offering to pay it back at so much month.0

Might also be worth double checking that your friend has actually been overpaid... They should be able to show evidence. But otherwise yes they are entitled to it back, but some sort of deal should be sort on how quickly its paid back.0
