Car on HP but knackered! What to do?

We have a car on HP but it's cylinder head is gonna go so cant use it. Hubby needs a car for work (temp contract at the mo) Is an HP car safe if so would it be wrong to trade it in and swap it still on HP before BR? Nothing flash just a car to get him to work?
Court date March 6th!

a) you need to check the wording on the HP agreement to see if there is a bc clause
b) if not then let the OR take it.Get a banger after bc:D
c) not sure on "taking on cedit knowing you are insolvent" comebacks,if you trade this one in and get another
