BR - What happens to arrears in joint names?

Hi all,

My partner is going to be filing for BR soon. We have some arrears on council tax and utility bills. Can these be included in the BR if they are in joint names?

Will they just chase me for the arrears instead of both of us if she includes them in the BR?

I am not being named in the BR.

    If you are not going BR the entire joint debt becomes your liability.

    I am interested in this too. I was sequestrated over council tax debts which accumulated whilst living with my ex partner. I assumed that the whole debt would be written off in the bankruptcy as council tax debt is considered joint and several? Does this mean that as I am bankrupt my ex will be chased for the debt? Totally confused!!

    My husband entered into an IVA last year and our joint overdraft debt was included in it for the whole amount, the bank voted for the IVA, now I am being chased for the full amount again by a debt collection agency because the bank have sold it on although it was a joint debt they can pursue just me now So I guess they want to have their cake and eat it, I don't know if it's the same for council tax and utility bills but I expect so.

    Yes, council tax is a joint responsibility so your ex is now responsible for it and they can chase him :D.
