Bankrupcy and a removing a partners name from a joint account.

I have debts amounting to £23000, of which £5000 is an overdraught with Barclays. I had my partners name removed at the begining of Dec 08, this was the only connection she had with any of the debt. As my work has almost completely dried up and my health is starting to suffer I now have no choice but to declare myself bankrupt. My question is very simple and has probably been answered somewhere before on this wonderful website but I can't find it, Is removing a partners name from a joint account enough to stop a bank from chasing them for the balance?
The National debt line advised a notice of disassociation but as far as I'm aware this is only so she avoids a poor future credit rating.Any help so I can get this process underway asap would be fabulous.

    Make absolutely sure that Barclays have completely removed your partners name from the account....if the account was overdrawn at the time they can be reluctant to take off one party as it means if they cant get the money back from one party then they at least have 2 nd party to chase for the debt. Removing a party can therefore increase the risk to the Bank.

    Get a statement to confirm that its in sole name & make sure they have removed connections on their systems....go into a Branch & check that with a Personal Banker.

    If you have any joint debt ...that includes mtge then one party BR automatically sends that debt to the remaining partner.

  • They asked me to give a reason in writing which I did and then the cheque book and paying in books were renewed and statements since have only had my name on them. The account definitely only has my name on it now. What do you reckon? Safe to take the plunge yet?
  • You should be ok....they can`t reinstate a name on an account & if they do they are in big trouble. If you have card & books in sole name that is proof enough.

    Have you opened another account for after the BR ? one where you can run without odraft ? Barclays cash card or Coop cashminder?
  • I thought I needed to be BR before I could even approach another bank. Making sure my partner won't be hassled once I've filed for bankruptcy is my main priority at the mo. Every other post regarding joint accounts and insolvency seem to suggest just the removal of the other account holder removes them from any trouble. Just seems a bit easy. We also live in rented accommodation so have no house to lose.
  • I opened a Coop account early as I want to stop using the odrafts at my main Bank. That way I am not using the overdraft wherever possible.

    Others have done the same & the OR has accepted the new account.

    Keep reading & building your knowledge...no 2 situations are the same but it pays to get a good understanding.

  • I've just paid a visit to Barclays and asked them if my partner has any link to my account at all and they said none at all. I asked for written confirmation but they said they could only give it verbally. Obviously I didn't tell them I was asking because I was thinking of bankruptcy but the personal banker couldn't be more certain that she now had nothing to do with the account. For some reason I'm still worried they'll attempt to recover the overdraft from her. Naturally suspicious of banks.
  • First direct have refused to remove my name, so I am having to close and my OH open a new account and change her DD's
