House repo and br

I am considering going br soon and have a few questions.

I have a joint mortgage with my ex but we have both moved out of our house, it is being repo'd on Monday.
If I am made br and there is a shortfall in mortgage, can it be included in br?
If it cant be, will my ex be liable for this?

I live in Scotland, dont know if that makes any difference

    Hi clydesmum,

    as you are in scotland, it could be different but here in merry ol england (!) If only yourself goes BR and there is a shortfall on the mortgage - the whole amount will fall due to the other party to repay it unless they go BR too - in which case it would be included in the BR.

    Coolcait seems to be our scottish expert if she is around at all.
