My husband and i are both regeistered disabled and live in rented house with two children. Car is motability. no other assists Obvoiusly receive income via benefits, what will happen to these? Will account be frozen? Will landlord have to be informed, will we be asked to leave?

Car wont be touched if its a motability lease....benefits not touched some taken into consideration depends what your receiving.....landlord depends if there's a bankruptcy clause in your tenancy agreement...bank account again depends who this is with? the only 2 bankrupt freindly banks at the moment are the co-op and barclays...most others will close your accounts when hearing about your bankruptcy

My husband also has a motability car, I have been led to believe this will be safe, it is owned by motability not you.
Your bank account will probably be frozen. it depends who you bank with. The co-op or barclays both do bank accounts for brankrupts. I have a co-op account. My account prior to BR was frozen. (mine was natwest and i owed them money)
The Official receiver will probably tell the landlord you are BR. do you owe him any rent? or up to date? remember even if he asks you to leave you have rights as tenants and can fight it. If you have no arrears you will probably be ok.
If your only income is benefits it is unlikely you will have to pay anything from them towards your bankruptcy.

Hi, thanks for reply, we are up to date with our rent, currently bank with Barclays but they are one of our creditors? Nothing in rent aggreement abot bankruptcy? Receive DLA Income support and INcapacity Benefit?0

Hmm barclays were one of my Biggest creditors and they offered me a basic account...they may close your account & offer to open up a "basic" account no o/d no cheque book...if not you can always look at the co-op for an account.
Good to hear the rent etc is up to date....the official receiver may ask to see your tenancy agreement so you can ask if he'd rather not contact your landlord when you have an interview...they might not (they've not in the past with a few members)...worth a tryWe all die. If the Motability lease is due for renewal during your bankruptcy period, then your OR will need to write to Motability to confirm that they have no objection to your entering into a new agreement, but this is just a formality so nothing to worry about0
