Going Bankrupt in Northants

I have been reading this forum for the last 18 months and it has provided me with lots of useful information and help on my journey through my debt.

Basically due to many reasons I went into a debt management plan in October 2007. Unfortunately my husbands company is now failing and as a result I have now gone bankrupt. However, throughout this process it has been a real comfort for me to read this site and know that other people have gone through the same process. So first of all a big thank you to everyone who has posted on here - it has always helped.

Because of the help that I have had I thought I would pass on my experience of bankruptcy in Northampton as I think it will help anyone who is about to do it who lives in that area.

First of all I filled in the form on line (I have to say that was a complete nightmare!). I then contacted Northampton County Court who advised that they have free legal advisers in on Monday, Wednesday and Fridays who will go through your forms with you and offer any free advice. Apart from that we didn't need an appointment and could just turn up and it would all be sorted there and then.

So on Friday 23 January I went to the court with my form and my money. I had to wait about 20 mins but then saw the guy from Welfare who gave the free advice. He looked through my form and made any corrections where he thought it was necessary. He also advised me on my personal situation and what official receiver would look at and question me on. He advised that if they put an earnings attachment on me I would be discharged in 12 months but if not it would be 6 months. He then took me to see the Clerk to pay my money (£495!!!) and to sign the forms etc. This all took about 40 mins in total.

After we left the forms were sent to the Judge for rubber stamping which would make it completely official. From there I now have to wait to hear from the Official Receiver who apparently does everything over the phone.

I hope that this helps some people who are going bankrupt in Northants feel a bit better about going to court. It really wasn't as bad as I thought and I would really recommend taking advantage of the free legal advice.

I will update once I have had the interview with the official receiver!
