Yes it is a temporary measure unless the first PWC closes the case, waits 13 weeks and then re-claims, then both cases woudl be on CS2 straight away and no phasing applies,0 -
First of all the 1st EX would be daft to close her case ,wait 13 weeks and then reapply until CSA2 !
Getting me down needs to apply asap to the CSA for an assessment under whatever rules apply now.
Please remember that csa is only due to the older child for another 8/9 years and once the child is an adult (under the CSA rules) then you can apply for reassessment for your child and should get a higher amount 15% until your child is also 18/19 years of age.0 -
I'm in the same situation - 1st PWC receiving £450, I will be receiving £250 once the assessment has been done - and tbh I couldn't care less. I understand that she has been receiving this since they split up, and it is deemed unfair to expect her to accept a £200 drop in maintenance without a period of time to get used to it. I'm not sure I agree with how long the phasing takes - about three years or so
- but I know I would appreciate a suitable period of time to adjust to a new budget. In the end, as long as your ex is paying his share of the maintenance, and your child is happy, isn't that what counts? i have a 5yr old son with my ex - he has never paid a bean in maintenance. i work full time and pay for child care etc to afford an ok standard of living for me and my little boy. The ex also has two daughters from a previous relationship (aged 12 and 10) who he has paid nothing towards either. He is now in another relationship and has got the new gf pregnant. Guess its just a matter of time b4 this girl is another statistic for the CSA etc etc...Anyway, CSA have the Legal Enforcement team on the case, cos he simply refuses to acknowledge the letters they send out to him. Last I heard they were sending the bailiffs in, then they said they were considering letting him off if they could retrieve the money by DEO....He owes both me and his first ex thousands, How the hell are they gonna get that from a DEO. He's a slippery beggar -already said that he'd once changed jobs to keep the CSA off the scent. Nice bloke huh?:mad:0
