Being pursued for a debt I don't owe by SRJ

Hi 10Past6
Thanks for the reply.
It was Hutchison that issued the default. I will send them a letter asking "why?. Will they not just write back saying that it's because I owe them money?
Do you think it would be better to wait until I have the results of the SAR which might at least tell me what the debt is supposed to be for?
I thought it might be worthwhile getting a note of correction added to the file which at least indicates I'm disputing the existence of the debt. Or would this be a total waste of time?

Personally, I wouldn't waste my time with them, you could write to Hutchinson and ask form confirmation why they issued the default.
You need to create a paper chain, in the event of this reaching those in authority to act for you.
And don't forget, if you prove your case and any complaint you make is upheld, you can sue those that issued the default.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

Hi 10Past6
Believe me I don't want to spend any more time than I have to on the CRA's. Problem is if this thing remains on my otherwise unblemished credit record then I'm a bit knackered for a mortgage renewal, etc because the rest of the industry seems to take anyting written on a credit file as gospel.
Or do you think we will reach a situation similar to that with car insurance where companies are beginning to ignore camera fines because they are so frequent and often spurious?
Cheers

Hi,
I have kept my CRA account going and am glad I did, I checked it yesterday and I have 48 Linked addresses that are not mine.
A few months ago I had letters and phone calls from SRJ and Capquest both stating I owed large sums of money to Goldfish Credit Cards (never had one) and 26K to NatWest (never had an account or card). I made the mistake of getting into conversation with them and confirming my address. They asked me if I had ever lived in Derby and Birmingham. I have never even been to these places and have lived in only 2 addresses since leaving home.
I explained this and asked them why they think it is me, They just said it was upto me to prove it wasn't my debt and the odds of someone with the same name was unlikely. When I explained that my name was probably one of the most common in England he just said so what. he also said that the information was supplied by Experian. I logged onto my account and there was no reference to these addresses or lenders.
After not hearing again i presummed they were just trying it on but when I logged into my CRA account it showed 48 linked addresses. Some names were not spelled like mine some initials were different but they were on my credit report.
I have phoned Experian and they said send an email with the details of those to be removed and they would look into it, I am not holding my breathe though. Surely they should have checked that they were mine before adding them amd also I did not receive an Alert to say thay had been added. (thought that was what the 4.95 a month was for)
There are also some defaults added for Orange and Vodafone that I am sure are not mine as I have never had a vodafone contract and I am with Orange now so why would they not just send me the bill. There are some others that I need to look into as my ex wife was prone to getting credit cards and loans without me knowing
Thanks0 -

At the end of the day, they MUST prove you're liable for this debt, you don't have to prove anything.Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

Hi 10Past6
I've looked at a number of posts on this and other forums and seems that 3G don't need to offer much in the way of proof e.g. a signed agreement to continue to assert that it is my debt as mobile phones aren't covered by the CCA. What I can't fathom is how I'm going to convince them that they've made a mistake. It seems akin to trying to nail a jelly to the wall.

Hi All
I've had a letter back from Hutchison 3G stating that they can't discuss the "account" because my address doesn't match their records. This is complete crap. When I originally called they had my previous address on their database and I have provided them with my current address.
I have sent them a SAR, but I have a nasty feeling that it went to the DCA by mistake. I was going to issue 3G with another SAR in response to their letter.
They have requested;
Full name -they keep spelling my christian name incorrectly by 1 letter.
Signature - no chance!
Account number - I've quoted their number in correspondence.
Mobile number - funnily enough I don't have this because I never had a phone or contract with them in the first effing place.
Old and new address with postcode -they already have this.
Does anyone know what information I need to provide them with for them to have to proceed with a SAR? I'm loathe to give them anything further for obvious reasons.
Thanks in advance0
