Hi,just wondered if anyone here was on the scottish Debt Arrangement Scheme? and if so could I pick their brains?????

    I'm not on DAS myself, but I know a bit about it. Unfortunately, I don't have internet access at home just now (laptop in laptop hospital!), so I probably won't be able to get back to you for a few days - when I manage to visit the library again.

    But please feel free to ask questions, and I'm happy to try to answer them next time I get logged on to a computer/MSE.

    1, can income tax arrears be added to das?
    2,can a car on h/p be added (paid approx 3/4 of it)?
    3,can business overdrafts be added?
    4,is it true das will be available via a.b.gov.uk,thus avoiding the need to see a money advisor (the reason i ask is there is a huge waiting list in my area)will it be this year on that site?
    5,is there a minimum amount of money you have to pay each month(i am getting conflicting advice from different agencies)
    6,is there a maximum amount of time you have to pay it ?(again getting conflicting advice)
    7,whilst on das can creditors contact us ,hassle us?
    8,could a personal overdraft be added ?(overdrafts and mortgage is with hbos could they call in their mortgage loan if we added the overdrafts to das?
    9,would we have an interview with trustee once on das?would we be monitored say every 6 months?
    10, will das administrator/money advisor need to see proof of self employment income i.e books?
    anyway i think thats enough questions for now lol!!!

    I'm sorry if it felt like I was ignoring you - thankfully I've finally got my laptop back, and I have really missed it!! I think I might need to have a word with myself about internet addiction...:o

    Anyway, here are some thoughts in reply to your questions.

    Yes, they can. Any ongoing income tax has to be paid as normal (like ongoing council tax), but arrears can definitely go in.
    2,can a car on h/p be added (paid approx 3/4 of it)?
    No, I'm afraid not - HP debts can't be included in DAS :( . But, if your other debts are being dealt with in the DAS, that might make it easier for you to manage the HP payments. And, if you are worried that the DAS might not be approved, you can also point out that you could increase the DAS payment once the HP is finished. That might help swing things in your favour.
    3,can business overdrafts be added?
    It depends on the type of business. If it was a 'sole trader' type set up, then business debts can go into DAS

    It looks like that's what's coming :T . A front page 'announcement' on the AiB website says so: http://www.aib.gov.uk/News/releases/2009/01/13215620. It doesn't give any idea when it's likely to happen though, so I doubt if it's going to be any time soon. It might be worth giving AiB a call, and asking them if they have any idea when it will happen?

    I'll answer 5 and 6 together. The law doesn't say that there's a minimum amount, or a maximum length of time. But there seems to be a commonly held view that the maximum length should be 10 years - maybe because ten years is a long time to be on that kind of debt management budget, never mind any longer :eek: . But the bottom line is that if all your creditors agree to the DAS (or don't reply to the DAS offer) then the DAS has to be approved. I don't know if that will change if the AiB take it over.
    7,whilst on das can creditors contact us ,hassle us?
    The law says they can't. That doesn't stop creditors trying it on :rolleyes: . But - just like with bankruptcy - you actually have the law on your side, and can freely tell them that they are breaking the law. You also have someone who is managing your case, and you can refer the creditors to that person (who will, hopefully, put a verbal rocket under them!:j :beer: :rotfl: )

    Overdrafts can be included. The secured lender could call in their loan, as they have that right anyway. However, if it went to court, and you showed the Sheriff that you were on a DAS, and were paying back your debts (including the overdraft) diligently, he might not be too chuffed with the secured lender's shenanigans!
    9,would we have an interview with trustee once on das?would we be monitored say every 6 months?
    There is no trustee in DAS - the way it stands just now you'd be dealing with a money adviser - usually in CAB or local authority. They have to review your case every 12 months. But, if you needed to see them more often than that, or needed to apply to change the amount you're paying each month, then there's absolutely nothing to stop you doing that.
    10, will das administrator/money advisor need to see proof of self employment income i.e books?
    If you're including business debts, the money adviser might need to see proof that they're valid for DAS. And they might need to see income evidence to back up your SoA. If all your creditors accept the DAS (which might mean that they just didn't answer...;) ) the DAS administrator probably won't ask for anything, as the DAS should just be approved. If they do ask for something, I've heard that they sometimes ask for a copy of the SoA, but I haven't heard anything abou them delving any deeper than that :confused: . Of course, that might change if they do take over dealing with the whole process...:eek:
