IVA and getting out of it the easy way....

I missed my Jan payment as I said because basically, I could no longer afford it and having sent my paperwork in to DFD for a review in November and, telling them that I was £130. down a month due to ex stopped paying they still wanted the £298.
I had a phone call from them yesterday and they were quite stroppy, I explained that I no longer got the £130 and the woman demanded what I had done with the other £160 that I could pay. She told me to write a letter explaining why I wanted a review and list all my expenditure again so that they could look at it. Anyhow, got letter today with their original expenditure and it states that OH is bringing in net pay of £1,000 per month. Now I know why my payments are so high. It may be this with overtime but, they state they do not include this in the sums.
I did a calculation online and found his actual net pay is £860 per month and then he has to pay his pension out of that.
I have now sat down all morning and worked out the new expenditure and found that they have us bringing in £1,865 per month with going out £1.597 leaving £268 per month and yet I am paying £298. The actual figures are coming in £1,635 and going out £1,679 which actually leaves us short. This I did by adding it all up and dividing by twelve as they do.
So, I am going to post this off with the hope that they will now suggest that we go bankrupt as we have no money. Yippee.
I read somewhere on line that you have to prove to the judge that you have been in contact with your IP to try all avenues as well as a failure before he grants bankruptcy so just doing a bit of lip service really to cover my !!!!

    Spender when you write include what you have said here and also say you have taken PROFESSIONAL ADVICE from one of the debt charities and have been advised that BR is an option for you so you are no longer going to pay the IVA as you are saving for the BR fees and wish them to fail the IVA and send a certificate.

  • I never though of that Tiger. I will have to edit my letter to them. I think that would be the best idea and then I have actually asked for the failed certificate.
