Who to contact when a company goes bust

I hope this is the right place for this question, it seems to fit here better than other places, anyway.

A while ago i posted a question about how to get a deposit back from a company that went into administration. I have written to the Halifax to see what they can do as the deposit (£200) was paid using a Halifax Visa Debit card.

Just in case I don't get anywhere with that approach, does anyone know who I should write to next? My daughter went to the business premises of the company concerned and someone did say they would send a cheque, this hasnt happened, the business has now ceased trading, there is no one around, so how would i be able to find out who is dealing with administration.

I know that there will be a long line of people wanting money, staff, suppliers, etc., evenso I would like to add my name to the administrators list just in case there is a remote possibility we get something from them.

sounds like it's probably in liquidation rather than administration.

if it is a limited company then you may be able to find out on the companies house website. you need to know the company's name.

    www.companieshouse.gov.uk/info

find the company and look at its liquidation history. the liquidator's name and address should be available, then you can write to them and say you want to register a claim. they should write back and provide you with a form to fill in - they'll also need evidence to substantiate the claim. you'll then become an unsecured creditor.

if it's not a limited company, then i don't know!
  • If the company has fallen into administration, there should be a name of the administator(s) and an address to write to. If the company has collapsed totally then you should direct your enquiries to the Official Receiver. In the case of Visa Debit I thing I am right in saying that they will refund if you write to them setting out the details. Although they refund along the lines of Section 75 of the Consumer Credit Act, I am not sure if they are bound by it

  • Just an update, i typed up the letter on MSE to ask the Halifax for their help in returning the money from the company that went into Administration. Handed it into the local branch as I thought they would know the company and could possibly pass on any details needed by their head office.

They email me back to say that they had passed on the letter to head office and would keep me informed as to what was happening.

I had a message left on my home phone asking me to ring them and give some more details. I did that asap. The lovely person on the phone said they needed more information, they then looked up the company on the internet, saw it was in fact in administration and said I could have the money back and to expect it in my account within 5 working days.

Five working days later I had my two hundred pounds back!

So a success story for me, thank you MSE for the letter to get the ball rolling, had i written it myself i would have droned on and probably annoyed the lovely person into making thngs harder.

  • Just another update, a message from the bankrupt company has just been left on my answer machine they say they have my money and would i like to collect it!!!

I have emailed my local Halifax and asked them what i should do.

I suppose they will want me to collect the money and hand it over, which is the most sensible thing to do, but seeing as banks havent been acting too sensibly they may say it is a closed file and to forget it.

In which case i would collect the money myself.
