Im still sat in shock from my discussion with CCCS.
I had it all planned....................... carry on paying the mortgage, and and something towards the 2 month arrears from ages ago..............my brother pays £1 for BI........................and one day get my ex off the mortgage.........................................................................
Then just like that the bloke ses.......Find somwehere to live quick, they will repossess when they find out you are BR?????????...............Dont worry any shortfall after repo will be included in your BR??????????

I though I would be encouraged to try and save my home Im shock shock shocked, now looking for house to rent in absolute panic......
He said the OR will look to sell it anyway because I could rent cheaper
Didn't see this coming, plan not worth the paper it wor written on, never assume always research more first

CCCS do not always give the right advice for YOU!
At the end of the day its up t you how you want to play it, a clean break might make sense, but thats not taking into consideration your feelings, something that is easy to egnore from the other end of a phone;)Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….

No the mortgage company won't turn round and reposses, especially in the present climate and definatly not for 2 months behind.

Does anyone know about BI and the ex then? Is the BI offered to anyone, or would the ex be offered it first as he is on the mortgage/deeds???0

The mortgage is 560 next month ( dropped from 817!!!!!!!) I want my brother to buy BI, but an earlier post on here suggests to the ex will get first refusal!!!!!!! (told by CCCS I will be able to choose)
Can the OR sell if its joint????????????? Surley the co owner has to be consulted??????
Its all fine and dandy saying move out move out u have nothing to loose, what about the effect on me and thie kids, not to mention the death threats I will get from the ex!!!!!!!! If not BR then yes The OR must consider the 'innoscent' party to some degree (not much though:rolleyes: )
Can the OR sell if in joint names, good question, i can see a few issues in that, but have never seen them challenged im afraid.
But the OR does not care who pays the BI, as long as they get it, even if its zero so they can close that chapter.

Infact Ive panicked too much before thinking rationally, Im going to save the mortagage money under my matress, and stay put for now, that way I can see what the OR wants to do with the house first. If he shows no interest in the house then I will negotiate with the mortgage people, Ill tell them I have money for missed payments (all but the 2 month arearrs) and are they happy to carry on as normal. But then again could they screw me over by saying yes and I pay any arrears then they still repossess? If they wont agree to "no repo" I will move out not forgetting future rent payments from under my mattress

KMH, as I said on your previous post, this was really bad advice from CCCS.
They will not repossess just because they find out you are BR. Even if you didn't pay the arrears but didn't allow them to increase they still would be unlikely to repossess in the present climate.
The OR isn't going to sell your house as there is no equity, they're not going to turf you out for the sake of it.
As far as I know you can choose who buys YOUR BI, it won't have any effect on your ex's BI at all.
There really is no need to make any hasty decisions regarding the house, stay put, see how things pan out, if eventually a year down the line you decide you don't want the house then move out, but there is nothing to gain bt leaving now, and a whole lot to lose.
If you do take this persons advice and let the house get repo'ed the shortfall would not go into your BR, they would chase your ex for the whole amount, for the next 12 years.
