JUst spoke to BR team at CCCS, OMG

JUst spoke to CCCS Bankruptcy team, (just for confirmation on what you guys have told me, and for the judge to see I have taken advice.)

I was telling him about how I got to this place and that I moved here to be with a guy, and I miss being near to my family.

I told him I was 2 months in arrears with mortg from ages ago, he said it not advisable to go BR with arrears, as they may come and repo asap.

He said "look chuck you dont even like it there, find somewhere to rent and send them the keys back, let it get repo and the shortfall will for him to sort" "get your own back"

OMG, I thought he would have said " hold onto the house, keep making those payments"

Im more confused and scared than ever now

And also is it truw that I can include council tax arrears???

    Hello keepmyhouse,

    A few people on here have done exactly that - left their houses and rented somewhere prior to going BR.
    I can't remember if you wanted to stay in the house, with a username like that I had assumed that to be the case but if not, why not look into what they said?
    If you did move away from your home area just for the guy wouldn't it be nice to move back?
    You are probably reeling from being told something that you hadn't thought of.... I was like that when they first suggested BR - that wasn't even on my list of options... and yet here I am a few weeks later.. BR!
    Good Luck .... and if you do move will you change your name to leavemyhouse? :D

  • I did think I would stay here, but the advisor pointed out that I could rent for less and any shortfall would become the responsibility of my ex, ( who in 1 months time will have a price on my head ah ah )

    I have been thru sum stuff in my life and I mean sum bad stuff, but my god this is the scariest by far!!!!!!!

    I so know just what you mean....
    I just keep telling myself that this is the last thing in a long line of carp and from now on it will get better!
    I have done some pretty stupid things and been so wrapped up in it that i haven't seen or thought clearly for what seems like years. This BR thing has made me grow up and take control of my finances and in turn my life. It is scary but it is also a learning experience.
    Learning to deal with cash and not plastic has been an eye opener. I have become a tightass almost overnight!
    You will be fine... you just need the help and support, when you have the low times, that this forum always provides and the CCCS BR team are very good.
    Remember to look forwards and not backwards, leave that all behind! ;)

    Can you afford to pay the mortgage long-term?

    Not sure if you and the ex were married but if not, how easy is it going to be to get his name off the mortgage? He owns part of the property you are paying for and may be able to demand money from you in the future. And if he goes BR i the future, would you be at risk of a claim for BI from his OR, which you have to fund?

    Think you need some legal advice as well as financial advice.

    Sorry to say, but I'm really shocked at that advice, it's so completely wrong.

    As long as you make arrangements they will not repossess, infact you have a right to spread the arrears over the remaining term of the mortgage.

    There is no judge in the land who will grant posession if you are paying the mortgage payments and something towards the arrears, especially with just 2 month arrears.

    Bloomin CCCS, some of their advisors really do need a kick up the backside.

    If you want to and can afford to stay in the house what on earth is the point in giving it up. Just because the market is down no doesn't mean you'll always be in negative equity, and so what if it is, it's only relevant if you want to sell, if you don't intend to in the foreseeable future it really means nothing.

    Sorry, it makes me really angry when so called 'advisors' come out with bu11sh1t.

  • Yes I can make the mortgage payments, but maybe not if the int rates go back up, I suppose there is a risk of him going BR too, he gambles, I did want to keep the house, but now I dont know what I want
