Failed IVA update

Hi all. Just thought I'd update you regarding my thread a couple of days ago regarding whether I have to officially fail IVA before petitioning for BR. I spoke to my local county court and they said they didn't think it mattered but they couldn't confirm this as there was no judge in to ask. They suggested I ring the OR, but they couldn't tell me either:mad: and suggested I ring CCCS. I tried them but as expected they had a high volume of calls so am probably just going to wait until March now anyway as I don't feel like getting turned away in February because of the IVA.

  • Just had another thought though. I read on a website that by law you are entitle to CANCEL an IVA anytime you want. If we were to CANCEL the IVA, surely that would constitute a failed IVA, am I right or wrong?

  • I also phoned my court today and the lady said that I would have to speak with my IP as she couldn't tell me if I needed the failed IVA notice or not. Very helpful i think, not.

    Me too!!

    I phoned our local court yesterday and they didn't know if I needed a certificate of termination for our IVA - quote "it's up to the judge on the day" - very very helpful NOT!! so I'm gonna get one anyway!! just to be safe!!

    I'm afraid that seems to be true.

    At some courts the staff can say with almost complete certainty what the judges like to do, but not at all. :confused:
