Advice required

Hi all
Looking for a little bit of help if possible.

We where discharged in Oct last year and we still have payments to make to our Trustee. Due to a decrease in finances (I am on a 4 day week with 20% cut in pay and and increase in my OH CSA payments - £750 out of our month income in total) we are struggling to pay what we agreed to Trustee.

I know that we can approach the Trustee and ask to reduce the payments but what would happen if we couldn't pay anything at all ?

    i would have thought that he would have to amend the IPA to reflect this, you cant pay what you havent got, that why we go BR in the first place. good luck, let us know how you get on

    Hi,

    You just ring them up and say you have had a change in circumstances and can you have another SoA form. Fill it in and send it back, recoded so you know it got there. The trustee will evaluate your new circumstances and lower or suspend the payments. If they suspend the payments these will still count towards your 36 months on the IPA.

    When you get your new form if you want anyone to check it then just shout.

    Would we still have to prepare and SOA if we are discharged ?

    We have our discharge certificates.

    Before we go to the Trustee we just wanted to know what they could do to us if we couldn't pay back anything at all - could they BR us again ?

    It would be a much shortened SOA, not the full court docs but just your income and outgoings.

    Thanks - we last supplied one just before we where discharged - saying that it was only my OH that has been asked to give his SOA for the last 2 years - I have only been asked once for my SOA
