Debt Collection Redress?

Hi this has been posted on the Mortgage Forum. Would someone please offer the OP some pointers.

I just recently found that a debt collection comany that should have been taking a D/D for a debt, had stopped trading back in Feb 07 without informing me of this situation and this D/D was stopped at that time. Needless to say another debt collection has brought this debt and the figure is twice as much as the outstanding amount that was left when the first company ceased. If any one could inform me if I have any redress on the first company to reduce this large amount.

I'm not here to judge, I'm here to help, but if you believe that you've been paying a DD for almost 2 years, which has been cancelled, then that money should still be in your account, or am I missing something?Click here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.

10past6 is right - the answer is 'no'. The first DCA ceased trading and stopped your d/d. That was the correct thing to do.
The query you have is whether the new dca has the right to apply interest and at what rate.
As they presumably acquired the account for a pittance and you have been saving the d/d payment for two years, are you at the stage where you can just offer a sum in full & final settlement?0 -
Did this new company gain a notice of asssignment and the CC Agreement relating to this account . If they did then request copies .0
