Court Date Tuesday, Vol Repossesion

Hi Again,

Last minute things, we are now in rented, mortgaged property is empty, do we just call up the mortgage after the court day and let them know they can repossess,,,,,,,,,any suggestions greatly appreciated....

    Yes, you can do that but whatever you do DON'T sign anything to say you will be liable for any shortfall. They will try and get you to sign but just be firm and say NO. Tell them to refer to your OR.

    youve got me a bit worried with that post FYP, we handed our keys back to the bank last year, and i cant remember what was in the form we signed, are you telling me that there is a possibilty we will still owe any shortfall having gone BR last week?

    I think those forms are dubious at best but its best just not to sign them. I'm sure you're okay and wouldn't worry. Are you still in your house? If not do you know if it has been sold? Have they repossessed?

    Hadenough don't panic too much it just means that if there is a clause then the OR will just have to do more work and the company may start hassling you but you just have to keep re-iterating it was included in your BR

    Phew! thanks for that, its a real shame, we had the house valued at 185k 3yrs ago, and the bank have it advertised at 119k! and it still hasn sold. ho hum my own fault isnt it

    You can sign the forms if thats what you want, just cross out/delete the offending lines that mention you will be liable for any shortfall.
