My Car

My car is off the road at the moment. It needs a few things doing to it. Cant afford it at the mo, cos saving up for BR. It is worth approx £750. Will the OR even be interested if they cant even drive it from my home ?

Is the car essential?? If it is can you prove that it is?? If not then the OR may see it as an asset and it could be sold.0

Hi patsypat911. Thank you for replying. I need it to take my OH back and to to work, as he does'nt drive. As explained car off road at the moment,so OH boss has to come and pick him up. He is not happy about it, but doing it till car is back on the road.. Thing is dont want to pay to have it fixed if it is going to be taken off us.0

Does your partner work far from home?? Is there a bus route etc can he could use which maybe cheaper to use than the expense of a car? If the answer is no then you should be able to keep it, if you can prove that the car is essential and without it your partner could lose his job then there should be no probs.0

He works all around the surrounding local area. But to get to some of the area's he would have to get 2 to 3 buses. He works for a builder, so they are up and down everywhere. For how long who know's, the way things are going !!!0

I don't think the OR will be concerned if you need a car for your OH so you need to make a case for you needing the car. Only one thing is certain regarding cars and bankruptcy and that is you can never guess the outcome of whether or not you'll be able to keep the car. It is too grey an area. If the OR does take your car I think your OH will be allowed to buy it back at a good price. Well, if it isn't roadworthy at the moment you'll have to knock some money off the £750 that you think its worth.
Now does the car really belong to you? Who paid for it, when was it bought, was cash paid or any other method, whose account did the cash come out of etc etc etc. Tell us as much as you can. You may be the registered keeper of the car but that doesn't mean you are the legal owner. You may not even have to list it in the assets section but just in the section asking if you have the use of any car.

Hi fiveyearplan and thanks for replying. I bought the car about five years ago. I payed cash for it from a loan I had. My OH does'nt drive. All the documents are in my name. It is off the road at the moment and needs fixing. I cant afford to have it fixed yet as saving for BC. But I'm not going to waste my time paying to get it fixed, if I am going to have it taken off me.0

Do not tell the OR it is of the road, they will just take it, as it defeats any argument that it should be exempt, i have seen that happen before.
You have a valid reason for it to be exempt, even though it is used for your OH to work, the principle it is needed for work applys.Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….
