Job share but half the pay, is this legal?

Hi, can anyone help... I have just become aware that I am getting paid half the amount for a job I am sharing with another lady!
Apparently she was put on that wage before I started and I am not supposed to know this. However I overheard someone and when I asked her she said it is true!!
We are both employed by the same agency aswell! but to add insult to injury I actually do more work than her!!
For example I minute take where as she doesnt!!
What can I do??

Don't tell us too much or give out too much detail, as we all have crystal balls and can see your exact situation for your job type.

So you are a temp/contractor/employee - doing? You should know the going rate for your type of work?

Are you under paid and is work plentiful, if so register with another agency(s) and let the first agency know that they are not paying enough and that they are paying the other person £? more. If work is not plentiful don't tell the first agency.

The company that employs the agency and you, will probably be paying the same rate for both of you. If you are the better worker and liked and fit in, tell them you are looking for other work as this job does not pay enough and that your agency is not treating you fair and only paying you X p/h - I've know an employer to be vexed stating that we pay the agency Y but the person only receives X and there is a big discrepancy between x & y and you are now going to loose our custom especially as incentives that we pay our staff will largely end up in your pocket.

However at the end of the day striving for something better is so much easier, especially if you are that envious about someone who is more fortunate.
GOOGLE it before you ask, you'll often save yourself a lot of time. ;)

seems simple to me, speak to the agency

As bookduck states, the buisness will be paying XXX for you and your collegues services as a package, this amount would have been agreed when entering the contract

Your issue is with the agency, so ask them and point out what you have heard, I presume from your comments they will not want to lose you as this would lose face with the buisness using your services.

There are other agencies or does the buisness have any vacancies?

    good luck

If you are agency staff and start work as an employee with the company utilising you via the agency they may have to pay the agency a finders fee.

I work for the LA and we use agency staff long term for quite a few jobs. The LA is not concerned with what the agency pays their staff they are just concerned with what the agency charges them.

  • You are employed and paid by the agency so your grievance is with them and not where you're placed. I suggest that you don't take it up with where you're placed as you may find your services not required the following week.

The fact you work faster than her is irrelevent to your pay as it's done on an hourly basis, not piece work.

How much she gets paid is irrelevent too. There is no legal right for two people doing the same job to be paid the same, except where the difference is based on the grounds of sex.

In short, if you want a better deal it is up to you to negotiate it with the agency.
