distant selling rule

Hey guys.

Not sure if this is the right part...

but - I'm buying a sofa - they often alot cheaper online!

Obviously - when you buy things online / over the phone you get 7 days 'test and trial' period.... This comes under the distant selling rules...

As far as im aware - this would apply to sofas / suites....

However - my question is: Is there any way for a company to "opt out" of this?

Buying a sofa online = can't test it out.... thats why im asking :)

    No a company cannot "opt out", it is the LAW! and it does apply to sofas/suites, however bear in mind that if you decide to return under DSR, you may be liable for return delivery charges,(depends on their T&Cs), but not the original delivery charges, as to return under DSR, ALL monies paid have to be refunded.

    The 7 days are "7 working days from the day after delivery." and are not exactly a 'test and trial' period, more ;like a "do I like it". Same as if you saw it in a store and decided to buy, in that case you would have no reason to return unless the delivered item was faulty.

    I think they can exclude specially made items so make sure your sofa isn't made to order.

  • Its offically called the "Cooling off period" under the distant sales regulation.
  • Sofas are made to order so no you cant return them if you dont like them.

    Maybe try and find a stockist locally of the one you like on the internet and try it before buy try it ?
