Unpaid wages...

My partner started a new job on 17th December, working for DHL. In his contract it states that he will 'normally be paid on the 25th of the month'. Obviously he wouldn't get paid in December, but it appears he hasn't been paid for January either. In order for his pay to have reached his account for the 25th, it should have been paid Friday 23rd. He checked his bank again today, as any credits/debits for Monday 26th are done overnight on a Friday. He definately hasn't been paid.

He spoke to his employer on friday, who insist they have paid him. Talking to his other colleagues, two out of six of them have recieved wage slips, and been paid. The other four have not recieved wage slips, and have not been paid. They are all new to the company, starting on the same date.

I can't work out what has happened, and why payroll are insisting he has been paid, when he hasn't. His pay is now definately going to be late, and I am not sure what we can do to get it paid this month. To make matters worse, he isn't in work on Monday or Tuesday.

What should the first course of action be?

We are inconvienced and out of pocket now as a result. We could really do without this hassle at the moment. Any advice would be helpful.

Yes, it was payroll directly who he spoke to.
  • Sounds like unlawful deduction of wages.

Look at www.adviceguide.org.uk and either go to, or contact, your local Citizens Advice Bureau and ask to speak with an employment specialist or someone who can help. Some bureax have appointment systems.
  • We have a DHL in our town and I heard numerous stories about wages not being paid on time. Which for monthly wages is disgusting.

I'd wait a little longer . If you OH has just started a job being seen as a pain in the !!! may affect the possibility of him being kept on past his 13 week probation. (which I assume he is on)

Keep it polite for the moment. DHL are a massive company and I'm sure you will get the money owed. I would however keep a record of it for future reference.

I think the "normally" quoted by RubyShoes in 'normally be paid on the 25th of the month' means that that would be rather difficult to prove.

[Though perhaps actually easier to do in the first few months if no payments have been made to that schedule - presumably they would point to the general timing of payments to employees.]
