When you go bankrupt and have to give in 3 months of payslips is this 3 months up to date of going bankrupt or 3 months before seeing the or? We were going to apply in March but, other half had brill wage slip in this month after christmas so don't want to use that as is a quarter more than usual wage and it will go against us.

If you have to supply the last, just supply more, with a letter to explain that it was a one off, and the other slips represent your actuall income, there should not be a problem if you can show your true incomeThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….

thankyou. We are holding out as it is because of DFD. I thought they would have stopped our IVA with me getting more credit but, they phoned 11 jan to say all was ok but, by then we had decided to jack in and go for bankruptcy anyway as we couldn't afford the payments. We have missed the payment for 15 jan but all they have done is send us the paperwork asking for us to send in new paperwork for them to rejig it all. As I understand it we have to miss two payments to fail the IVA and then I suppose the creditors will soon be on our backs again so, reallywanted to be ready when the fail paper comes in.:rolleyes: Money Talks ...but all mine ever says is Goodbye! :rolleyes:0

splender. be careful when petitioning at court after being in an IVA, I went to court yesterday, and the judge was going to adjourn our hearing until i had proof the IVA had actually failed, I managed to convince him it had and all was ok, but i stopped paying mine in DEC07 and it officially failed in July 08! so it may take longer than you have anticipated, it may be that my company was a little slow in processing paperwork, but please check before you go to court, i would hate for you to build up to court and then have it adjourned. Also make sure you keep a list of your creditors from your IVA, most of the ones on my failed IVA havent come back to me yet after it failing so long ago, amd one of them is a 30k unsecured! but a list will help the OR process.0 -
Oh, hadenough didn't realise it took so long for the iva to fail. I thought it wored like that we miss a couple of payments, they fail us and write to all concerned and then the creditors would be on our backs again, which is why we are all set to go. I dont really mind if it is longer as we have a holiday booked in july and have had to sell the shares now to pay for spends and to pay for BR which I suppose would look bad. You are probably right, after you miss a couple of payments, YOUR iva may well have failed, after i missed a couple they were still onto me to make up the missed payments and keep going as normal. All iva's seem different, If they have told you that it has failed, then go ahead with your court date and convince the judge that it has (like i did) and you should be ok, I just know how much the stress builds up before your court date, and then you get adjourned!. I think the timescale with mine was more down to paperwork!0
