Hi dollydo - I had this term in my agreement and I did hand it back under this term but I had not quite paid half - I knew I would have a small shortfall which was about £550. So you can still use this clause even if you have not paid half.

Just be careful anyone doing this as when I worked out I would have a £550 shortfall, the company I owed it to tried to tell me that this amount excluded the insurance payments therefore I actually owed nearly double that amount.

I argued this with them because it did not say this on the termination clause and they had to back down and deduct the insurance costs off the remainder because it did not say "excluding insurance costs" in the terms.

startingover - It was Capital Bank that tried to do this to me so they may try the same with you! don't let them because it is not covered under the termination clause that insurance still has to be paid on top.

    Hi Don79,

Can I ask, what did they class ar reasonable condition ? Mine has a few bumps and over 100,000 miles !! They don't define the term reasonable ! Was it as easy to return as the agreements makes it sound. How long did it take?
    Thanks for any help.

they actually did come pretty quickly to collect it, just over a month I think.

Our car was pretty good, had the odd scratch and a tiny dent on the bonnet right in the middle (have no idea how it got there and we only found out when the man came to collect did an inspection before taking it away) and mechanically was good in terms of servicing. We had used it quite a lot for trips around the country to visit family but it was an 03 plate with less than 70,000 miles on the clock.

It was pretty easy but not painless because I loved the car! It was really silly but it was the car that we really wanted for our family and we had to get rid of it which made me sad and still does occasionally. But I knew we could not afford to keep it so it had to go.

  • Thanks for the tip Don79 I can't see it anywhere in the agreement if i've paid half I can hand it back. My car is not in great condition as a skip wagon clippped my right wing and drove off! Got police involved but as my excess is £300 I couldn't afford to claim.

it should be in a box entitled "your right to terminate" if I remember correctly. have a look for a box with that heading.
