BR and rent arrears help

I have taking advice from CAB and am going BR, went up to the courts last week to see The citizians advice people there as they deal with BR in more detail.
Most of the forms filled out and ready to go expect for one thing. I have rent arrears of £480 wich i owe to my housing association, these have occured as housing benefit pay a month in arrears. I am paying these off each month and didnt want to involve these in BR, but the CAB have said i have to, as i cant been seen to show favour to 1 creditor, but my rent officer says if i add them, then i put my tennency at risk. Is this right, will i be in danger of losing my home, so worried dont know where to turn, this is the only thing delaying me going to the courts to apply for my BR.
Have spent 3 days trying to get CAB on phone for advice.

    Hi pumpkinpatch, have you tried calling National debtline and asking about this?

    I know where cab are coming from about showing favour to a creditor but I don't know that this would apply where it would mean you lose your home.

  • This was something that came up in my BR with my council tenancy. What I did in the end is put the arrears in the bankruptcy but I also included them in my SOA with a note explaining why I had to pay them off. Technically they are wiped in the BR but if they aren't paid off then they can stop you passing on your tenancy, exchanging etc. There was a link to a court case someone put on the thread for me - perhaps it can be found again? Ultimately the OR's job is to help you and it doesn't if you're evicted for rent arrears. Not the same as a mortgaged property as you then have the option of perhaps applying for social housing - if you are evicted from social housing there's nowhere else to go. HTH
