Dismissal Advice Please

Good Evening,

Firstly I would like to say that I am a regular MSE poster, but for this thread have assumed an alternative ID for privacy reasons.

A brief background. I have been employed by my SME company since June 2007. For the last 6 months or so the Company has been underperforming in terms of turnover. My last monthly payment was late due to cashflow problems. I received an appraisal 2 weeks ago which turned into a shambles. Emails have been received, worded rather strongly accusing me of lying about my work and efforts. The most recent straw is having to produce a minute by minute account of what tasks I perform and how long each task takes to complete. I am classed as a Senior Manager.

I believe that they are plotting to lose me as an employee. I cannot work out whether they are trying to force me to quit on my own accord by taking bullying tactics, or if this is their funny way of instigating dismissal procedures.

My questions are, legally what steps do they have to take to dismiss me and if I was dismissed, would I be able to claim CB JSA whilst I look for a new job. This situation is very stressful, and I am scared to open an email from my boss for fear of what it holds. Any advice would be very much appreciated.

    Not necessarily. If they believed the employee to have committed gross misconduct, then summary dismissal is an option.

    OP, if you were to be dismissed, the JCP would ask for the reason as to why you lost your job, and they may also confirm/ clarify this with your ex employer. Then a Decision Maker will decide whether to apply a sanction on your claim, which could mean no/ reduced payment for up to 26 weeks.

    DMG, I do not believe that I am committing Gross Misconduct,but I don't know! All I can do at the moment is to keep plodding along, trying my best, but it's not at all motivational! I think I just need to prepare myself for the worst. Thanks for the link, that makes good interesting reading - at least I know what the correct procedure is, even if the company doesn't!
