Solicitor Advice

Not sure this is the right place for this , but I would like advice on if it is possible to change solicitors once things have been going for 6months+. My brother is going through a messy seperation trying to get divorced and his solicitors has said leave it to the wife to apply for the divorce and he is getting nowhere, started in June and she hasnt even applied for it yet, just costing lots of money and he is not getting any further.!:mad:

    You can change solicitors whenever you want. But, they only have to return their file to you (which you'll need to give to the next solicitors, so they can see what stage has been reached) when their bill has been paid in full.

    If the wife applies for the divorce she will pay far more of the costs. Not sure why it is costing your brother money if the divorce is not progressing and he isn't applying for it?? Are they doing all negotiating via the solicitors? If so get them to use (free) mediation instead. Then solicitors just rubber stamp the agreement.

  • All negotiation is via solicitor. very messy seperation , one child involved and not allowed to speak directly to each other. thanks for the advise.
  • Its likely the other solicitor is saying the same and waiting for him to apply and incur more cost, its a case of who blinks first.
