Can Anybody Advise Please?

Hello,

Any help would be much appreciated!
I'm posting on behalf of a collegue but as I'm a reg here (and work know that!)...I'm incognito!

Okay....Friend has been off work sick since Sept 08. Has had previous long term sick leave. He was on full pay...and still is but expecting to drop to half pay soon if not back in work.

Manager has called him in for a meeting with himself (the manager) and a member of HR. Normal procedure.

Letter states a couple of bullets that he doesn't understand. Neither do I!

Payroll has advised manager to inform him of sick leave entitlement as follows:

1: Reduced to half pay with effect from 00/00/00 (Sept it says)
2: Will cease to be in receipt of sick leave entitlement from 00/00/00
3: Will cease to be in receipt of SSP entitlements as from 00/00/00

1:He has not been on half pay from that date?? Could this just be a typing error?? Confused as they are looking at dates closely?
2: Does this relate to entitled to time off sick. Nothing about pay.
3: Will all payments stop if he is not back at work?

Thanks you for any help you can give!

JC

Can't we have the exact dates? Might make more sense, I am struggling to understand what you mean!

  • Lol i was just being nosy around the boards but i havnt got a clue what you mean without the dates on either....
    Having a coke with you
is even more fun than going to San Sebastian, Irun, Hendaye, Biarritz, Bayonne
or being sick to my stomach on the Travesera de Gracia in Barcelona
  • Sorry..

I'm not going to put exact dates as people will click.
The dates are not relevant anyway.

I supose to simplify things he needs to know what 'Will cease to be in receipt of sick leave entitlement' & 'Will cease to be in receipt of SSP entitlements ' means.
The 2nd we presume means no more sick pay. The first we're not sure about.

    Thank you.

OK. I am making an assumption that your colleague is normally entitled to company sick pay which is more that statutory sick pay ie SSP. In which case what happens is:

Full company sick pay which includes SSP will be paid for as long as your company sick pay policy says it will.
It will then reduce to half pay, also including SSP - again, if your company sick pay policy allows this.
Once half pay runs out, they will get SSP only until that runs out.

It completely depends on your company's sick pay scheme.

Having read your post again, you need to clarify what type of sick pay they are entitled to.

SSP is a statutory payment which is paid until it expires (can't remember the rules off the top of my head).
Your company may pay over and above this, normally known as company sick pay. It is up to a company whether they pay this. You will know whether they do from your contract, staff handbook etc.

The meeting could also be to ascertain when he is likely to return to work or if he has a long standing problem that he may need help with e.g. reduced hours, adjustments to his workspace etc etc.

What others have said about sick pay is correct so I won't bother repeating it.

If there is no chance of him ever returning to work then the company need to know that and take steps to remedy the situation - e.g. ill-health retirement.

PS. If your friend is in a union, perhaps he could take a union rep with him to the meeting?
