The OR cannot force you OH to claim benefits. But if your OH did claim benefits and put that money towards the household expenses it would look better. Going on your original S of A with nil surplus, if JSA meant a surplus of £262 per month, then you would be asked to pay an IPA.
As you OH has been made redundant they have paid there Income tax and NIC, they should claim what they are entitled to, in my opinion.0
