SoGa rights - Replacement item

Not sure if this is the correct part of the forum for this but I figure the mods will move it if I am wrong.

I recently bought a computer component which turned out to be faulty.
I returned it to the retailer who confirmed the fault.
The item cannot be repaired.
The item is now end of line so they cannot provide a like for like replacement.
They are offering an alternative of a similar price but lower specification.

They are insisting that the replacement the item they offer only has to be based on price not function and if I want a comparable but more expensive replacement, I will have to pay the difference.

If the replacement item offered is not 'fit for purpose' (it is a lower specification and will perform to a lower level than the one I wanted) can I insist on a comparable replacement and expect the retailer to bear the cost?

  • I don't think you can insist on a higher price one and expect them to bear the cost - it is a "goodwill gsture" if they do.
    Can't you get a refund and purchase it elsewhere?

    They don't have to replace it with a higher priced item, that is down to an individual stores own policy. If they cannot replace it with a item at the same price, that is of the same specification, then you can demand a refund though, there is no reason that you should accept a lower spec product.
    If repair and replacement are not possible or too costly, then the consumer can seek a partial refund, if they have had some benefit from the good, or a full refund if the fault/s have meant they have enjoyed no benefit

    So demand your money back and take your custom elsewhere.

    The problem is that the item is end of line and while it is still available at some places, it costs a lot more (£40 - £65 to be precise) so I guess I will take a lower spec item rather than have to stump up the difference.
