    It's not fraud. it can only be fraud if you intend to permanantly deprive the other of it. look at section 17 theft act 1968. Additionally there is an offence of kiting cheques slang fro writing cheques that you know will bounce but if you post date them then it is a fair assumption that you expected to have the moeny available and circumstances changed prior to that. therefore no offence back to a civil debt.

    Inmypocket, thanks for those links, i shall have a look at those, last week my loan went out then the bank took it back and charged £30 straight away, i would have thought they should let you know first before they take charges.

    It sounds like you're spending more than you have coming in. Can you post your ins & outs so we can help you with a budget?

    completely agree, plus my banks phone number goes through to a call centre in india and they didn't even understand what i was saying.

    My OH lost his job just before christmas, he has been promised another job, but it won't start until mid Feb, I have applied for couple of part time jobs, just waiting to hear if i got any. We have been waiting for our jsa for 4 weeks now, not had a letter telling us how much we are getting or any money. We have used all our savings on food and electric etc. so are now totally pennyless, My OH is going to sign on again Tue, so he will ask them what we are supposed to live on, i don't care about me and OH not eating, but i need food for my 4 year old son, my family have been very good, in giving us food, but unfortuneatly they don't have any money i could borrow.
    so total incoming, Zero, Outgoing, Zero, i can't afford to buy a loaf of bread how about pay my bills, thank goodness for milk tokens.
    So anyway back to pay day advance cheque, do you think i should let them know that the cheques won't be hounered?
    As soon as me or OH has got a job i shall give payplan or cccs a ring.

    If you have access to a phone, get your OH to call Jobcentreplus first thing in the morning and tell them you need payment asap as you are facing hardship. They are slow to get payments up and running and in your positon, you cannot afford to wait. It will still take about 3 days for a payment to reach you once they have arranged for it to be paid so you need to get it sorted out as soon as you can.

    Sorry you are having such a bad time at the moment, I hope things turn around for you very soon.

  • what will probably happen is the cheques will be paid if they are guaranteed by your bank card, but to me i think that is a good thing because then your debt rests with the bank and not the extortionate payday advance. even if you get charged for each cheque that the bank has to pay, in the long run your debt will then rest with HSBC which can then be dealt with by doing the following:
    1)Explain to HSBC that you are aware of the debt/overdraft including the cheques. Tell them you are waiting for a job and advice about Debt Management Plan from the CCCS and offer to pay them £1.00 per month as a token payment.
    2) Cut the guarantee card up and send back to them with a letter explaining your commitment to paying them back.
    3) Open a basic bank account elsewhere so that any future wages going in wont be taken by the bank automatically.
    4) Get advice from CCCS about this and any other debt. They will help you set up a DMP and freeze charges/interest, etc so you can pay HSBC back.
    Debt Free Since September 2005!

    BJL I know exactly how your feeling at the moment, I went through this about 3 years ago, it feels that everything is closing in on you, and you've got no way to turn! Firstly take a deep breath and step back form the situation.... Ok now first thing you need to do is go to your local jobcentre and speak to one of the people in there, expalin the situation with your claim, tell them that you've not had any payments and the fact that you and your partner are both out of work and you've got a little one to look after. Then ask them for an "Intrim" payment of your benefit - You'll have to sign a form to explain why your requesting the benefit and that if your it comes to light that after processing your not entitled to the benefit you'll pay it back.

    If they refuse to do this or look at you blankly, then ask them for an application for a "Crisis Loan" - This form will 10 pages (ish) and should be processed by the staff that same day - So if your entitled to a payment you'll get it that day!

    I'll not bore you with the details, but if the Crisis loan people are doing their job properly, they should refuse your application for the loan on the principle of your entitlement to be paid benefit - and they should initiate your intrim payment that day! However this really depends on their training? Either way you should leave the office with a payment of some sort?

    You should be aware that the above might take all day, so be prepared to wait around, you'd be best not to take your little one in with you, they get bored very quickly in these situations! And remember that not all staff in jobcentres are rubbish - so try not to lose your temper :o

    Yes - 4 years working in the Jobcentre, you pick a few things up :A

    Secondly you need to speak to these Cash Generator people, and fully explain your situation, hopefully they should be able to do something!

    Hope this long and rambling post has been of some help to you, if you get no joy @ the jobcentre feel free to drop me a line and I'll see if I can shead some light on the ways of a Jobcentre. :confused:

    Also contact the local authority you may be entitled to council tax benefit based on nil income, and if you rent your home help with housing benefit. You can also ask for these payments to be back dated if you have good reason for not applying previously.

    Just a note on the Jobseekers Allowance claim. They will ask you to pay your money into a bank account. Explain you are over your limit and don't want your money paid into the one you have. Ask for details of a Post Office card account as this is where they can pay your JSA and you can get your money easily. If you get an interim payment ask for it to be paid by giro first until you get the PO account sorted. Don't forget MAKE SURE THEY DON'T PAY YOUR MONEY INTO HSBC. or you may end up with nothing for you and your family to live on. (From another Job Centre Worker - we're not all po-faced pen pushers!!!!)
