Questions about bankruptcy - and claims against me

I was thinking of going bankrupt last year towards the end of last year at least, and the cost of actually going bankrupt and the finality of it, put me off. More recently I have written to all I owe money to after consulting with CCCS, and a solicitor - and made offers. As I'm unemployed many are unwilling to even accept token payments.
The first has now issued a claim against me from the court the first one I've had. It's the University for accomadation and fees. They said they know it won't help them get their money but they just want to damage my credit to stop me taking future credit.
I'm sure others will eventually do the same. Given that I have no realisitic chance of paying them and that they're actually taking me to court now (some are 5 + years old) - I think I just need to go bankrupt to draw a line under it all.
If I actually manage to save enough to go bankrupt.
1. Can you tell me if it will take care of this recent claim made against me by the University. 2. Can you also tell me how long it will be before my credit record will show no sign of my bad debts at all, and be perfectly clear? Does it ever become perfectly clear?
3. From memory when I spoke to the County Court last year they told me they operate a non appointment type of arrangement where you walk in wait and see the judge the same day. How long after this day am I officially bankrupt?
Thanks..

Hi App,
You can forget about credit reference for at least 6 years & it will never be perfectly clear
Would suggest you deal with the now rather than the futureThe triumph of hope over experience

Thanks Dez, the thing is they are both pretty closely linked. I'm all for living in the now but my future is as important to me as the now to be honest.
My credit file is screwed completely at the moment. I will never be able to get a mortgage - etc... If the BR will stay with me indefinately then I don't see much point going for it, well that's not quite true. The release of not having the 8 companies constantly on my back will be nice. But I'm not sure that alone is enough to sway me to bankruptcy.
I will never pay this money back, it's just not doable for me. Most are debts I accrued at the age of 18. So BR or no BR I am not going to pay the debts, I can't - certainly not unless I take a job which pays me 3x the highest salary i've earnt in the past 27 years - which is just not likely to happen.
My NOW is plagued with how the next person will respond, will they take me to court - will my credit be further screwed, it's very bad now I've not been able to take any credit of any form for years - but the prospect of this being the case for the rest of my life isn't nice. I want to own my own house at some point, I never have.
My FUTURE is where the hope lies - which is why I'm as focussed on that as I am my present. I want to reach the point one day where I can sleep safe in the knowledge that I owe no one nothing, and will one day be able to get a Mortgage - I guess that's what I'm really trying to find out here. Can a BR get a mortgage and is it hard for them to do so, later when they've sorted their life out? If someone searches a credit file - will the BR always show up? I knows its in the LG ad infinitum, but does the same apply to the credit file?
- Also, and this is cheeky I know... but I just can not afford the money to file for BR. If I borrow the money from a doorstep lender for the exclusive purpose of filing for bankruptcy, will this cause me problems with the Judge or OR?whinge intr.v. whinged, whing·ing, whing·es Chiefly British To complain or protest, especially in an annoying or persistent manner.0 -

It might take a few years of saving for a deposit but the bigger the deposit the better. Unfortunatly the credit crunch has put the kybosh on how easy it used to be, reletivly, to get a mortgage a year or two after BR. But it should be possible the further away the BR gets. As I said just save while you can for a deposit.

No you cannot borrow the money from a door step lender, this will be heavily frowned upon and cause you a few problems with the OR.
As you are on benefits you will get a remission on the court fees of £150, so will only have to pay £345. Will this still be difficult?
You must talk to one of the debt charities about your situation. If you don't the judge can delay your petition untill you have.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0 -
Thank you for your reply it's much appreciated.
I've already spoken with the CCCS back in December and have written confirmation from them, but unfortunately because of the current climate the there are no grants/special loans available to file for BR. I really am penniless at the moment...I don't have anyone in the family I can ask either. I'm currently Llving from one week to the next. I do not have any way of raising the BR fees - I've been unemployed for five months and have actively been seeking a job to no avail.
If I do borrow the money to file for BR and the OR frowns upon this, what is he (a) likely to do to me because of this? and (b) what is the worst he could do because of this? I just need to get out of this it's been 10 years now and I don't think I can just let it continue like this, so if it's a case of special restrictions are a dressing down from the OR that's fine as things can't get any worse, but if he can actually reverse the BR or cause me very serious problems then I'd like to know...

the doorstep lenders have collection methods which would/could result in you not being able to type for a long time, or play the violin or sing tenor....
