PLEASE HELP, empire direct refund

Hi

I returned a faulty tv to these guys 7 days ago and was waiting for a refund. They said they would call me Tuesday to arrange a reufnd.

Now their site says they have gone into administration.

Is there anything i can do??? Have i lost £1100 i worked my butt of for and save up for months :(

So worried.

I paid by visa debit card and i know i can do a charge back but their company MUST have money in the account for that to happen.

    What is an owed creditor, i assume this means waiting for months and months

    Indeed and you will bv way down the pecking order, and almost certainly would only get a percentage of the original purchase price back, if you can prove they owe you the money.
    Have you got any paperwork regarding a refund or was it just word and mouth

  • Did you pay via credit card? If so (and if you've also kept copies of delivery notes to prove you posted it back) then you might be OK. Although the claims procedure can take a long time and the outstanding balance will sit on your CC bill until it's resolved.

    Phone your CC company to discuss the matter.

    Going to call the bank to do a charge back.

    Apparently it doesn't matter if the company has gone bust as the chargeback agreement is with their bank and NOT with company.

    Thats right, the chargeback is against the aquirer for retailer, which in turn will be debited from their account. Even if they have no cash in the account you would be refunded as thats the risk the banks take.
    These are my thoughts and no one else's, so like any public forum advice - check it out before entering into contracts or spending your hard earned cash!

    I don't know everything, however I do try to point people in the right direction but at the end of the day you can only ever help yourself!
