NO!! I haven't read all the replies so may be repeating.

DO NOT USE THE HALIFAX ACCOUNT. NO!!!!! You have a debt on it (the overdraft) and that HAS to be included in BR. You are not allowed an overdraft and the account must not be used. The Halifax person knows nothing about BR.

If your wages are paid into that account, Halifax WILL take them all and you will have a fight to get them back.

Get your wages paid into another account NOW. Call a trusted friend or relative to see if you can use their account for your wages to go into. The OR will not care, so don;t worry about that. Halifax are the nastiest a*se's when it comes to BRs. They are hateful to all debtors and you will not be any different.

Get your Co-Op account sorted today. RIGHT NOW - Call them if you haven't already. DO NOT USE YOUR HALIFAX ACCOUNT.

Hi Peacy and Dee Dee - I feel bad now if that bloke will get into trouble but at least I was honest with him so have nothing to be afraid of in that way but I am going to open a Barclays account and deposit the £600 ready for the mortgage payment and then set up new direct debits.

Will my wages still be paid into the Halifax even if they close it and then they can recover that £600 back?

I will make arrangements for my wages to go into my new bank but don't want to do anything until the £600 has gone back? Not sure not what to do about this money?

I will not use the credit card even though he said it would be ok - he obviously is not aware of the procedure of the bank.

If you get paid before they close the account they will take the £600 out of your wages and should then send you the remainder, however they may decide to send it to the OR, or even pay off anything on your c/card (even though they're not allowed to)

If you get paid after they have closed the account it will bounce back to your employer's account. They will then demand immediate repayment of the £600.

The best thing to do it open your new account for your wages to go into, you can apply to co-op and Barclays and see which one comes through the quickest, then keep the £600 to one side to give to Halifax when they ask for it.

Skylight, I don't think OD can be included in BR, it was taken out after, so will not form part of the BR. I'm sure Halifax being the way they are will realise this and expect Worried to pay it all back pronto.

  • Wow it looks like I have made another problem for myself drawing that money out but I only did it because the bloke from Halifax said I could.

Halifax sounds like a nightmare after reading your comments - I thought I was doing right going to see them as my account didn't have an overdraft before I went BR - it was only when I went into the branch to let them know I had been made BR

I have now opened a bank account with Barclays but it could take a couple of days they said to get it set up so will have to make alternative arrangements for my wages.

I assume the OR will not take kindly to me drawing this money out after being made BR

i am just waiting now for the contact from OR and can't wait for it all to be over so I can get my life back

I reckon the man at the Halifax was a complete newbie or handed his notice in just before you went in :D

You made a genuine mistake Worried, I think the best thing you could do is explain what has happened to your OR and see what they advise, they may well say it serves Halifax right! It's better the OR hears it from you though than hearing it from the Halifax.

In the meantime, put the £600 to one side and don't spend any of it.

  • Hi Peachy

Thanks for that - will definetely keep the money to one side now - it looks like I drew the short straw with this guy and I thought he was being really nice - no doubt his superiors will give him a hard time when they see what has happened - I am so glad I came back on this site - it is a real comfort knowing people are so nice and kind

Peachy thanks for pointing it out! - I read the original post that there was a £1k OD and only a spare £2 left on it (so a debt of £998) and that they were going to extend that OD. Re-reading it, I see the OP was in credit of £2 with a OD unspent of £1k, so was able to take out the £600!

Either way, Halifax will freeze the account and take the wages - £600 to cover the new debt and the remainder just because. They may cover a credit card or perhaps send it on to the OR. They may even do nothing and wait for the OR to claim it. Either way, they are heartless gits and will make this hell if not very careful.
  • Hi Skylight

Thanks for your response and I will get my wages paid into another bank - I will have to wait now and see what the Halifax will do as regards the 600.00 pounds
