IPO's and IPO's on benefit income?

As mentioned in my spider post, I am disabled, and my husband is out of work at the moment, claiming Carer's Allowance for caring for me. We receive:
Child Benefit (for 2 children)
Incapacity Benefit
DLA
Child Tax Credits
Carer's Allowance
Small CSA payment
We have our rent and council tax by benefits currently
I have been told by the CAB that we shouldnt be given a IPA or IPO as we are on a benefit only income. Is this right?
When will we find out if we have to pay anything back?

Yes.....................
Unless you end up with earned income (or that derived from it like WTC) then it will not apply.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

You shouldnt, i know they dont really class my tax credits and child benefits as income.
The best thing would be to post your SOA for the experts to look at, so we can get an idea of your incomings and outgoings...Number 001 of 2009! :T0 -
You wont be given an IPA(O) at all based on where your income comes from. You should have been told that you will be unlikely to get an IPA.
However, they cannot tell you that you definitely wont be given one, in case your circumstances change whilst BR that would mean that you will pay an IPA. (As in your OH gets a great paying job). An IPA must be in place before your discharge or one cannot be implemented at all. But you wont be given one.
In fact, (only I went BR), when OH got a job, I still did not have to pay an IPA as my own income was CTC and CB only.0 -
Thanks guys

I was told, by CAB, that the DLA and Carer's wouldnt be classed as income also. We were told to offset my DLA as care costs in our SOA as they wouldnt be counted anyway.
With my DLA or Carer's not being counted, we are way under the £100 a month disposable income barrier anyway.:T 434 of 2008 :j0 -
Have just remembered that during my OR interview, I was told that we MAY receive a IPA/IPO form in about 3 months or so, and to send it in asap and our BR period may be as low as 6 months then. So, I am confused

I know he said 'may' but surely we wouldn't get a form to fill in if there is no IPO/IPA on a benefit only income?:T 434 of 2008 :j0 -
That is just the name of the form, IPOQ. You fill it in and send it back within 14 days. This is the process.
The OR will firstly send 'report to creditors' this is normally done within 8 weeks of the making of the bankruptcy order (your appearance at court etc). It's the initial report from the OR that tells creditors (amongst other things) the reasons for the insolvency and the likelihood of creditors receiving any payments from the estate.
The OR's office must then wait 3 months before they can consider starting the ED process if they feel it is appropriate.
For the ED, you have 14+7 days to return the IPOQ (I&E questionnaire..this is sent to you from the OR office if your considered for ED) after which the OR can write to the creditors to say that they will be applying for the ED and request any objections.
The OR's office must then wait 28 +7 days to allow creditors to reply. Then if no valid objections have been received, the ED notice can be submitted to the court.
So the quickest the ED could happen (in theory) is 56-57 days after the you get the ED/IPOQ letter.
it often takes longer and can even be shelved at any stage if the office is too busy with new cases as ED is NEVER a guarantee...

Thanks tiger
That's very helpful.
So there is still a chance of ED even if no IPO/IPA is being paid?:T 434 of 2008 :j0 -
Yes even more so
