Possibly being chased for debt written off in bankruptcy

Hi there, I hope you can help. I'm in a bit of a pickle right now and am looking for direction and advice. (please bear with me!)

I went bankrupt in Oct 06 but I think I'm being contacted for a debt that was included in the final amount (excuse bad terminology/lack of 'jargon')

I contacted the owed company (3 mobile) and they tell me that the account isn't showing as cleared by bankruptcy. (although there is a slight discrepancy as to who's account is being chased - my old account or the account I took out for my friend - they - 3 - can't give me old payment history/d.d details of closed accounts - although neither is showing bankruptcy - bear in mind it was only MY account, not my friends that was included in the bankruptcy - oh, and I'm no longer friend with the person, or else I could have asked her)

Also I am unsure if I still have all my paperwork from the bankruptcy as I moved house a few months ago and cleared a lot of old (and I thought un needed - idiot!) paperwork but I do think I have details of the company that dealt with it, but not 100% sure... (I'll start looking for that) but if it was for my account, I am 100% sure that 3 were included (although I don't think the amounts aren't the same)

I'm really rubbish at looking after my own affairs and am incredibly unorganised (which is how I get into this god awful messes :( ) so would appreciate any help or advice you could possibly share with me... But please don't tell me I'm useless, I know that already....

    Hi fairydust,

    If the bill pre-dates your bankruptcy it will be included, regardless of whether or not they were put on your forms at the time. All you need to do is send them a copy of your bankruptcy order (if you can find it :o).

    if you cannot find your BO you can find details of your BR on the London Gazette website, it will be there forever, just give those details to 3 and tell them to contact the OR.

    You definitely do not have to pay the bill.

  • If it was a debt(liabilaty) at or berfore the day you went BR it is included in your BR, whether it was listed or not.

    What concerns me even more is they cannott actually prove what the alleged debt is for, if they cannot prove it owed, and in realation to a valid account they cannot collect it anyway:confused:
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    Thank you so very much for your information... I've looked on London Gazette, found my details, contacted the debt recovery company and they've passed my details onto their admin department to remove my debt from their system.

    You lot are flippin marvelous and I've very very grateful. I no longer need worry!

    Sorry to butt into your post but reading it does this mean that ALL debts up to the date of the BR being granted are included in the BR even if you genuinely forget about them? and later like this poster they turn up and ask for the money, when I suppose Im asking is I have I think some debts from quite a few years ago, they are not on my credit file as debts but am worried they may appear when I petition for my BR, sorry this isnt clear., as i have buried my head in the sand so long my brains gone into remember only what I want mode.
